General Terms and Conditions
General
1.1 These terms and conditions are applicable to all promotions, orders and agreements from Badjasparasdijs.nl trading under the trading name Badjasparadijs, located at Scheybeecklaan 20, in Beverwijk, The Netherlands. Badjasparadijs is registered at The Netherlands Chamber of Commerce in Haarlem with the registrationnumber 34298502. (BTW number NL142817077B01)
1.2 Upon placing an order you will be deemed to have accepted the Terms and Conditions.
Badjasparadijs.nl reserves the right to change its general terms and conditions after the duration has expired.
1.3 These Terms and Conditions may not be otherwise amended except if agreed in writing signed by you and us. The remaining Terms and Conditions remain of power unabridged.
Prices
2.1 All prices mentioned on the website are in Euro’s, inclusive 19% VAT and exclusive handling and shipping costs.
2.2 Prices will not be changed during the duration of a promotion, unless governmental regulations make this necessary or in case the manufacturer carries out a price increase.
2.3 All prices on the website are under reservation of printing and typing mistakes. No liability can be claimed as a result of a printing or typing mistakes.
Delivery
3.1 Delivery takes place as long as stock is available.
3.2 Delivery will take place within 1 to 7 working days within The Netherlands unless mentioned otherwise on the website. In case the delivery time of 7 days will not be obtained, the client will receive an e-mail from Badjasparadijs.nl in which the proper delivery date will be mentioned. In that case the client has the right to terminate the agreement with Badjasparadijs.nl, by stating this in writing (letter or e-mail) to Badjasparadijs.nl.
3.3 The indicated shipping times on the website is for information only and is not guaranteed. Badjasparadijs.nl can not be held liable for the mentioned shipping times.
3.4 Payments that have already been made by the client will be transferred back to the client’s bank account as soon as possible, but in maximum 14 working days after Badjasparadijs.nl has received a request to terminate an agreement as stated in article 2.2.
3.5 After the client has received his/her ordered product, the client has the right to break the agreement with Badjasparadijs.nl after 7 working days. The client does not have to give a reason.
3.6 If the client would like to terminate the agreement as a result of article 3.5 of Terms and Conditions, the client has to mention this in writing (via letter or e-mail) to Badjasparadijs.nl. The client has to send that product back in the undamaged and original seal, after consultation with Badjasparadijs.nl, to an address determined by Badjasparadijs.nl. The cost and risk of sending back the product in that case is for the customer.
3.7 In case the client has already made payments at the time the client revokes the agreement with Badjasparadijs.nl in pursuance of article 3.5 of these Terms and Conditions, Badjasparadijs.nl will pay the client back within 14 working days after Badjasparadijs.nl has received the returned product from the client. The delivery costs that Badjasparadijs.nl has made to send the product to the client will not be refunded. Therefore the client will receive the payment made to Badjasparadijs.nl minus delivery costs.
3.8 Badjasparadijs.nl has the right to refuse returned products or to pay back only part of the payment of the client, when is suspected that the product has been opened, used or damaged by fault of the client (other than by Badjasparadijs.nl or the supplier of the product.)
3.9 In case a product is returned that by judgement of Badjasparadijs.nl has incurred damage due to the handling or failure of the client or is for the risk of the client, Badjasparadijs.nl will notify the client in writing (letter or e-mail). Badjasparadijs.nl has the right to lower the amount of money refunded by the loss of value of the product as a result of this damage.
Privacy
4.1 When you place an order by Badjesparadijs.nl, your personal information will be added to the client database of Badjasparadijs. Badjasparadijs.nl will not disclose personal information to third parties, in accordance with the law concerning the protection of personal information.
4.2 Badjasparadijs.nl respects the privacy of the users of the website and treats all personal information as private and confidential.
Agreement
5.1 An agreement is made between Badjasparadijs.nl and you as the “Buyer” after Badjasparadijs.nl has assessed the feasibility of your order.
5.2 Badjasparadijs.nl reserves the right to deny an order or task without mentioning a reason.
Images and specifications
6.1 All images; Photo’s, pictures, etc. and (technical) specifications ; such as details concerning weight, size, colour, etc. on the website of Badjasparadijs.nl are indications and cannot be a reason for damage compensation or termination of agreement.
Force majeure (non-liable failing)
Badjasparadijs.nl cannot be held responsible if it is prevented from fulfilling any of its obligations as a result of force majeure.
7.2 Considered as "force majeure" are each circumstance, cause or event, which in all fairness falls outside the sphere of influence of badjasparadijs.nl. The following are considered as circumstances, causes or events resulting in force majeure: delay or hinder of transport resources, lack of transport resources, strikes, governmental actions and regulations, delay in supply, failure of suppliers and/or manufacturers of Badjasparadijs.nl as well as failure of helping people, absenteeism of personnel, lack of help and transport resources.
7.3 As a result of force majeure, Badjasparadijs.nl holds the right to postpone the execution of the agreement and also has the right to dissolute all or a part of the agreement, and can alter the agreement in such a way that the fulfilment stays possible. In no case can Badjasparadijs.nl be held responsible to pay any fines or damage costs.
Complaints
8.1 All complaints related to delivery, quality, or other complaints, will be taken seriously by Badjasparadijs.nl
8.2 The client has to file the complaint by Badjasparadijs.nl in writing (via letter or e-mail.)
8.3 Badjasparadijs.nl will try to solve the complaint within 10 working days.
Badjasparadijs.nl will report back to the client in writing (via letter or e-mail).
Communication
9.1 Badjasparadijs.nl is not liable in any way for misunderstanding, damage, delay or not properly transmitting of orders and communication as a result of the use of internet or any other communication tool between the client and Badjaspoaradijs.nl, as well as between Badjasparadijs.nl and third parties, as far as it involves the relation between the client and Badjasparadijs.nl.
Intellectual and industrial ownership rights.
10.1 The client has to completely and unconditionally respect all the intellectual and industrial ownership rights which apply to the delivered Badjasparadijs.nl products.
10.2 Badjasparadijs.nl does not guarantee to the client that the delivered products do not infringe any intellectual or industrial ownership rights of a third party and cannot be held liable if a third party claims that a product delivered by Badjasparadijs.nl infringes an industrial or intellectual property right.
Miscellany
11.1 When the client of Badjasparadijs.nl states an address in writing, Badjasparadijs.nl is entitled to send all orders to the stated address until the client gives a new address.
11.2 Badjasparadijs.nl has the right to use a third party to arrange the handling and packing of the order.
Suitable law
12.1 The Dutch law is applicable to all promotions, orders and agreements from badjasparadijs.nl.
12.2 All disputes between parties will be submitted to the exclusive jurisdiction of the courts in The Netherlands.
